These Terms and Conditions (“Terms”) govern the purchase, activation, and use of NuuTel eSIM travel data plans (“Services”) provided by NuuTel (“NuuTel,” “we,” “us,” or “our”). By purchasing, downloading, installing, activating, or using a NuuTel eSIM, you agree to be bound by these Terms. If you do not agree, do not use the Services.

 

1. Eligibility & Requirements

1.1. To purchase a NuuTel eSIM data plan or subscription (“Data Subscription”), the User must provide a valid email address and agree to these Terms and Conditions at checkout. By completing the purchase, the User enters into a binding contractual agreement with NuuTel for the acquisition and use of an eSIM and agrees to pay all applicable charges associated with the selected plan.

 

1.2. Setup of an account and password is required to access and maintain a NuuTel user account. Account access is provided via a secure ‘My Account’ section on the NuuTel website.

 

1.3. Certain NuuTel plans may operate as subscriptions. Where applicable, no additional installation is required beyond the initial eSIM installation, and the eSIM will remain valid until the User cancels the subscription or fails to make required payments. There is no minimum or maximum subscription duration unless otherwise stated.

 

1.4. Subscription-based data plans operate on a rolling billing cycle (typically every 30 days) and will automatically renew at the end of each billing period unless the User cancels the subscription prior to the renewal date.

 

1.5. During the purchase process, the User will be required to set up a valid payment method, which will be used for automatic renewals where applicable. Downloading, installing, and activating the eSIM and associated data plans may require a stable internet connection.

 

1.6. By purchasing and using the Services, the User confirms that they own or control an unlocked, eSIM-compatible device that is supported in the destination country or region. Device compatibility is the User’s responsibility.

2. Nature of the Service

  • NuuTel provides data-only eSIM travel plans. Voice calls, SMS, MMS, and emergency services may not be supported unless explicitly stated.
  • Services are provided via partner mobile network operators in the destination countries.
  • Coverage, speeds, latency, and service quality depend on local network availability and conditions.
  • Please note that to ensure you receive the best coverage, our official eSIM technology partner is Airalo. While your service is provided through us, you may see the Airalo name appear during the installation process or within your device’s network settings.

3. Purchase & Delivery

  • Pricing Fluctuations: Please note that eSIM pricing is subject to change from time to time as a result of changeable wholesale pricing and competitor market environments.
  • Delivery Method: Upon successful payment, the eSIM profile will be delivered electronically via email, QR code, or within your NuuTel account.
  • Security: You are responsible for securely storing your eSIM QR code and activation details.
  • Non-Transferable: Once delivered, eSIMs are considered issued and may not be transferable.

4. Activation & Validity

  • eSIM plans may activate automatically upon first connection to a supported network in the destination country, unless otherwise stated.
  • Validity periods (e.g., 7 days, 15 days, 30 days) begin upon activation, not upon purchase.
  • Data allowances expire when either the data quota is fully consumed or the validity period ends, whichever occurs first.
  • Unused data is not refundable, transferable, or carried over.

5. Fair Use & Acceptable Use Policy

  • NuuTel data plans are subject to Fair Use Policies (FUP) imposed by partner networks.
  • Excessive usage, tethering, hotspot use, or abnormal traffic (including but not limited to VoIP abuse, automated systems, or commercial resale) may result in throttling, suspension, or termination without notice.
  • You agree not to use the Services for any unlawful, fraudulent, or abusive purpose.

6. Warranty Disclaimer

6.1. These Terms and Conditions are provided in addition to, and do not affect, any statutory rights you may have as a consumer under applicable law.

 

6.2. To the maximum extent permitted by law, NuuTel provides the eSIM, Data Subscriptions, and Services on an as is” and “as available” basis. NuuTel makes no warranties, representations, or guarantees of any kind, whether express or implied, in relation to the eSIM, Data Subscriptions, or Services, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability, except where such warranties cannot be excluded under applicable law.

 

6.3. NuuTel reserves the right, at its sole discretion and without liability, to modify, suspend, discontinue, or cease the sale, provision, or support of any eSIM, Data Subscription, or part of the Services at any time, subject to applicable consumer protection laws.

7. Service Availability, Roaming & Coverage Limitations

7.1. NuuTel shall take commercially reasonable steps to ensure that the Services are available to Users, subject to NuuTel’s and its service providers’ ability to maintain network capacity, coverage, and connection availability.

 

7.2. NuuTel partners with third-party service providers, including mobile network operators, to deliver the Services. These providers, coverage areas, and network technologies may vary by country or region.

 

7.3. Data coverage, speeds, latency, and performance may be subject to the applicable mobile network operator’s Fair Use Policy. To maintain service quality for all users, network operators reserve the right to apply traffic management measures, including speed reductions or usage limitations, where data usage is excessive or negatively impacts overall network performance.

 

7.4. NuuTel does not guarantee uninterrupted service, specific network capacity, network quality, or continuous connection availability. Service limitations or disruptions may occur, including but not limited to the following circumstances:

 

7.4.1. Planned or unplanned maintenance, upgrades, or technical work carried out by NuuTel or its service providers;

 

7.4.2. When the User is located in areas not covered by partner networks, outside supported destinations, or outside the geographic scope of the purchased data plan;

 

7.4.3. When factors beyond NuuTel’s reasonable control cause disruption, including but not limited to device limitations or compatibility issues, regulatory or governmental requirements, faults in telecommunications networks, adverse weather conditions, radio interference, physical obstructions, or force majeure events.

8. Refunds, Cancellations & Right of Withdrawal

8.1. General Refund Policy

  • It is the User’s responsibility to verify that their device is unlocked and eSIM-compatible before purchasing a NuuTel eSIM.
  • Refunds are only available if the eSIM has NOT been installed or activated, except where mandatory consumer protection laws apply.
  • Refund requests must be submitted within 20 calendar days from the purchase date, provided the eSIM remains unused and not installed.
  • Refunds to the NuuTel account balance are free of charge.
  • Refunds to the original payment method are subject to a USD $2.50 (or local currency equivalent) processing fee per eSIM, which will be deducted from the refunded amount.
  • The processing fee will be waived where the issue is attributable to NuuTel, including unsupported destinations, incorrect plan information, or verified service faults.
  • eSIMs that are installed, activated, expired, partially used, or priced lower than the applicable refund fee are not eligible for refunds under this policy.

8.2. Legal Right of Withdrawal (Consumers Only)

8.2.1. If you are purchasing a NuuTel eSIM as a consumer, you may have a statutory legal right to withdraw from this Agreement within fourteen (14) calendar days from the date of purchase, without providing any reason, in accordance with applicable consumer protection laws.

 

8.2.2. The right of withdrawal will expire early if the eSIM is installed, activated, or the associated Data Subscription is used, consumed, or depleted (in whole or in part) before the end of the 14-day withdrawal period.

 

8.2.3. Where withdrawal is exercised after partial use of the Service (and where permitted by law), any refund may be reduced proportionally to reflect the value of the Services already provided up to the time of withdrawal.

 

8.2.4. To exercise the right of withdrawal, the User must notify NuuTel of their decision by an unequivocal statement (for example, through the account dashboard or by contacting customer support).

8.3. How to Request a Refund or Withdrawal

  • Log in to your NuuTel account and navigate to My Account > Downloads.
  • Select the relevant eSIM, click Actions, and choose Request Refund (or equivalent option).
  • If the option is not visible, the eSIM is not eligible for refund or withdrawal.
  • Approved refunds will be issued to the selected method (account balance or original payment method).
  • Refund processing times depend on the payment provider or card issuer and may take several business days.

9. User Obligations

9.1. Acceptable Use

The user (“User”) agrees that they shall:

9.1.1. Use the NuuTel eSIM and Services in compliance with these Terms and Conditions;

 

9.1.2. Use the eSIM in accordance with all applicable laws and regulations of the country in which the User is present, traveling, or ordinarily resident;

 

9.1.3. Not use the eSIM to engage in any fraudulent, criminal, unlawful, or abusive activity, or in any manner that impairs, interferes with, or damages mobile networks or service quality;

 

9.1.4. Not copy, store, modify, publish, distribute, or misuse NuuTel’s proprietary or commercial information, including confidential information or trade secrets, except where expressly authorized by NuuTel in writing;

 

9.1.5. Not use the eSIM to download, upload, transmit, or generate data traffic of an excessive size, quantity, or frequency that is inconsistent with normal consumer usage or Fair Use Policies;

 

9.1.6. Not use the eSIM in any manner that infringes upon the intellectual property rights, privacy rights, or other legal rights of any third party;

 

9.1.7. Not decompile, disassemble, reverse engineer, or otherwise attempt to derive source code from any NuuTel software, systems, content, or from the eSIM or services provided by NuuTel or its network partners.

9.2 Accuracy of Information

  • The User agrees to provide accurate, truthful, and complete information when creating an account, making a purchase, or submitting any request to NuuTel.
  • Impersonation, use of false identities, aliases, or misleading information is prohibited.
  • When providing information or usernames, the User may not use offensive language or names that infringe trademarks, trade names, or the names or pseudonyms of public figures without authorisation.

9.3 Promotions, Credits & Referrals

  • Any credits, promotions, discounts, or referral programs (“Promotions”) offered by NuuTel may only be used in good faith.
  • Promotions may not be used to undermine the fairness, integrity, or lawful operation of the Services, including through fake accounts, fictitious identities, or abusive behaviour to obtain rewards.

9.4 Suspension & Enforcement

  • NuuTel reserves the right to temporarily or permanently suspend or terminate the User’s access to the Services, including any active data plans, in the event of a breach of these Terms.
  • The User remains responsible for all charges incurred up to the time of suspension or termination.
  • NuuTel reserves the right to pursue all remedies available under law, including recovery of damages and legal costs, where applicable.
  • NuuTel may, at its sole discretion and without prior notice or liability, suspend or terminate Services where there are reasonable grounds to suspect that:
    • The User has breached these Terms, including unauthorized use, resale, or fraudulent activity;
    • The User has violated applicable laws, regulations, or third-party rights, including intellectual property or consumer protection laws;
    • The Services are being used in a manner that compromises network integrity, security, or availability, including excessive or abusive usage;
    • The User has provided false, inaccurate, or misleading information during registration, payment, or verification;
    • There is suspected fraudulent, unauthorised, or unlawful activity associated with the User’s account, including chargebacks, identity theft, or payment fraud.

10. Limitation of Liability

  • NuuTel provides Services on an “as is” and “as available” basis.
  • To the maximum extent permitted by law, NuuTel shall not be liable for:
    • Loss of data, profits, revenue, or business;
    • Network interruptions, delays, or service degradation;
    • Incompatibility with devices or local regulations.
  • NuuTel’s total liability shall not exceed the amount paid for the affected plan.

11. Indemnification

You agree to indemnify and hold harmless NuuTel, its partners, affiliates, and employees from any claims, damages, losses, or expenses arising from your misuse of the Services or violation of these Terms.

12. Privacy & Data Protection

  • NuuTel processes personal data in accordance with its Privacy Policy.
  • Network usage data may be collected for service provision, fraud prevention, and compliance with legal obligations.
  • Where applicable, NuuTel complies with the General Data Protection Regulation (GDPR) and other relevant data protection laws, ensuring that personal data is processed lawfully, fairly, transparently, and securely.

13. Changes to Terms & Services

  • NuuTel may update these Terms at any time.
  • Updated Terms will be posted on our website and become effective upon publication.
  • Continued use of the Services constitutes acceptance of the revised Terms.

14. Governing Law & Jurisdiction

  • These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction where NuuTel is registered, unless otherwise required by mandatory consumer protection laws.
  • Any disputes shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
